Yes, you can claim if you do not rent your property.

Property Tax Credit, NY IT 229. This credit is for taxpayers who pay more than 6% of their income for property taxes. The taxpayers cannot earn more than $250,000 and they must have been in their home for more than 183 days and they must be full year New York State Residents. In addition, it must be their personal residence.
