Home purchased in another state with daughter on the title but not the mortgage. Schedule E

We purchased a house in Utah that my daughter lives in part time when she isn't working in Colorado. She rents out rooms and sends me the mortgage payments of $1,600 a month. I live in CT. My daughter has claimed the schedule E last year can I this year and file a non resident Utah tax return?

It depends. If the home is not in your name, you cannot report the rental income on your return. The house is not in your name from your comments in the question, even though you have the mortgage.

Hi

Yes all three of our names are on the deed but only my wife and I are on the mortgage.   My daughter sends us the $1,600 most months. Her income is very low due to life choices but she pays the utilities and HOA fees.  The mortgage company pays the taxes and insurance.

Yes, you could enter the rental activity on your return this year since you and your husband are on the deed. Enter only the expenses you paid and the income you received. The mortgage company pays the taxes and insurance for you, but you pay the escrow funds so be sure to include those expenses. Don't take any excess escrow sitting in the account for the coming year expenses.
