Can the spouse that makes all the income, tax return be taken, after filing jojntly married and taken last year, get taken again when the spouse's who loan it is hasnt worked?

    Yes the refund from a tax return where you filed as Married Filing Jointly can be seized for a debt of a spouse.

     

    You should have filed a Form 8379, Injured Spouse Allocation with your federal tax return so that a portion or all of the refund would not be seized.
