How many years after the death of a spouse may you still file a joint return if you have received documents and tax taken out the year after their death?

    No, you cannot file a joint return for 2024 if your spouse passed away in 2023.

     

    For 2024, you'll need to report the pension payment on your individual return. The income is considered "income in respect of decedent" (IRD) and has to be reported using your correct filing status.

     

    Report the pension income on your return as if you had received it directly in your name. The fact that the 1099-R is in your spouse's name doesn't change how or where the income is reported.
