Live in Virginia, receive pension from Teachers Retirement System of North Carolina. NC state tax withheld on 1099-R. Do we have to file NC income tax form?

Yes, if you want to get any of the NC state taxes withheld possibly returned as a refund.

There is not enough information in your question to determine whether you are required to file a NC tax return (such as if you were a part-year resident), but the only way to get back those withholdings would be to file a return.  If you were a resident of VA for the entire year, then you would file a non-resident NC tax return. 

Also, be sure to contact the payer to request that they stop withholding NC state taxes.

Thanks.  Husband retired from State of NC.  Never lived there, always claimed VA residence, so considered non-resident of NC.  No VA state taxes withheld, only NC.  Not a lot withheld but I guess worth trying to get back, every little bit helps.  Thanks again for speedy response.
