Question

My ex is suppose to give me a 1099-R for the part of his military retirement I get but this is the 5th year and he wont give them to me. I am lost at what needs to be on it and how it is coded?

You should be getting your own 1099R directly from the DFAS.  It should have your address on it.  Ask them for another copy.  Your ex does not prepare a 1099R to give to you.  If he is paying you it might be entered as Alimony not a 1099R.

Thanks. I do get paid by my ex.  I am in the process of getting that changed.  But if I file it as a 1099r in the future will it be file so that I pay the same in taxes?  I mean I have filed it as alimony when it isn't that but will I penalized because I am not old enough to file a retirement?  Just curious.  Thank you for your help?!

The 1099-R you receive should be coded for an exception (Code 2) in box 7. That will eliminate the penalty and you would only be paying the normal taxes on the distribution.
