My husband had a 401k but did not take it out. they are asking us what we did with it.

there is not an option for me to say we didn't take anything out. he was laid off, I don't know if it was given to him in the last check.

You must have a 1099R and sometimes when people are laid off they are asked if they want to take the amount in the retirement plan out.  

If you believe the 1099R is incorrect, you need to call the prior employer or whoever issued you the 1099R.

If your 401k was small say a few thousand, the employer may close it out without asking you. You would get a separate check. You would have had 60 days to move it into another qualified plan.
