Should I put my son as a dependent if he is being filled under his mother ?

If he spends the most nights with mother, she is the custodial parent and gets to claim all of the tax deductions for the child.  You do not get to claim any unless she gives you a signed Form 8332 which gives you permission to claim the dependency and child tax credit.
