My husband lives in the same community as me and commutes between our homes. I am primarily responsible for the financial upkeep of my home. (He only helps with two utility bills most months, but not all.) The only thing he has at my residence is a few clothes in ONE drawer. He spent the majority of nights at my house in 2023, but also spent many nights at his home where he pays bills, cooks and keeps his belongings. Should I report that we lived together in 2023?"

    Q. Should I report that we lived together in 2023?

    A. Simple answer: Yes.

     

    That said, there is no place on the tax form to report whether you lived together.  So the real answer depends on what you are trying to accomplish?  You may use Married Filing Jointly (MFJ) filing status (or Married Filing Separately [MFS]), regardless of your living arrangement.  If you are looking to use Head of Household (HoH) filing status, you living situation does not meet the standard for having lived apart the entire last half of the year, based on your description.
