Line 29 of the IT-201 is the Pension and Annuity exclusion.

A pension is eligible for the exclusion if it is a distribution received by officers and employees of the United States, New York State, or local governments within New York State. These types of pensions are fully exempt from New York State, New York City, and Yonkers income taxes. If excluded, your entire pension would be on Line 29.

Any other type of pension may qualify for a pension and annuity exclusion of up to $20,000 in NYS, as long as your pension is:

  • included in federal adjusted gross income (FAGI);
  • received in periodic payments (except IRA or Keogh);
  • attributable to personal services performed by the individual before their retirement; and
  • from an employer-employee relationship or from an employee’s tax-deductible contributions to a retirement plan.

If receiving the $20,000 exclusion, you may see $20,000 or up to $40,000 if married filing joint.

After the input of your 1099-R on the federal screen, you must select the source of your pension correctly.

To get back to the screen, please follow the instructions below:

  1. Open your return.
  2. Search 1099-R with the magnifying glass tool.
  3. Click the Jump to link at the top of the search results.
  4. Edit your 1099-R.
  5. Continue past the amounts entered.
  6. On the screen, Where is your distribution from? choose the correct source.
  7. Answer the remaining on-screen questions.
