Can I file 763-S for the year 2023 to VA now in 2025?

My wife's employer mistakenly withheld state income tax for VA for the year 2023 and 2024. we live in texas. 

I know we can file 763-S for the year 2024 now. 

My question is, is it possible to file the refund form for 2023 now in 2025? or is there any other way to claim that money?

Yes, you may be abler file Form 763-S for the year 2023 to claim a refund of Virginia state income tax withheld, even in 2025. For Virginia Form 763-S, you can generally file for the current tax year and the three previous tax years - see page 6.  This means you can go back up to three years to claim any refunds or correct any errors related to Virginia income tax withholding.

 

Here's how to proceed:

  1. Complete Form 763-S for the year 2023.
  2. Submit the form to the Virginia Department of Taxation.
