That depends on your state's sales tax laws.  Chances are the answer is no, because anymore companies (such as Amazon, or even TurboTax, for that matter), will charge the appropriate sales tax when state law requires it.  So the download would only count as an out-of-state purchase if the sales tax was never charged and state law says that it should have been.
