Do I need to submit any attachments if filing in West Virginia as a nonresident?

We moved out of West Virginia in December 2023.  My wife is receiving a government pension and in January 2024 the pension administration inadvertently withheld state taxes from her annuity.  It was fixed the following month.  Now I need to file a West Virginia tax return to get that amount back.  I was told to file as a nonresident.  What,, if any, documents do I need to submit with my tax return?

    Yes, you should file as a nonresident and no documents specific to being a nonresident are required.

     

    According to the instruction booklet for West Virginia 2024 West Virginia Personal Income Tax Forms & Instructions, you are a full-year nonresident, and they do not require any special attachments.

    Thanks for this helpful information!  Since this affects my wife do we file as married filing separately OR married filing jointly  or does it really matter?

    It really doesn't matter.  West Virginia (WV) does not require the filing status to be the same as the federal. There should be a full refund of the tax withheld since you are nonresidents.
