filing state taxes as MFJ and all year non resident in either state

I got marred n early December so I understand we have to file jointly.

I am a 11 month resident of Massachusetts and my spouse is all year resident of Ohio.

Since both of have our incomes from our resident state should we file and jointly or married filing separate?

What are advantages and disadvantages for filing either way jointly or separately ?

    Since you did not reside within Massachusetts with your spouse for the same time period, you will not be able to file as Married Filing Jointly in MA.  

     

    Massachusetts specifically states you must reside there for the same period of time during the year.  If you do not, you will need to file as married filing separately for MA.

    You must file in Ohio using the same filing status as you prepare your federal tax return with.  If you choose to file your federal return jointly, you will need to claim a nonresident credit for the income not earned in Ohio.  If you file separately for Federal purposes, you can file separately for your Ohio return as well.
