How can I e-file if I am a resident of NYC and my spouse lives in a different state?

    You can efile the NY return on its own, it does not require the federal to be filed with it. See State e-file methods: standalone vs piggyback.

     

    NY allows a different filing status from the federal if one of you is a nonresident or part-year resident. You will do a fake federal MFS to create your actual NY return.
