Question

How do I divide nonresident/part-time resident income between 2 states?

I cant figure out how to calculate a part-time resident income for my daughter-in-law who got married last year in the middle of the year.  She started a job in Missouri in June after graduating from college.  She was living with her parents in Kansas at the time.  One month later she got married to my son and moved in with him in Missouri.  Do I need to split how much she made in the time frame she was living in Kansas versus Missouri?  Also, she did not change her address on her W2 form when she moved so her business took taxes mainly for Kansas for the whole time frame.  Does this have to be corrected?

Thank-you in advance for any assistance/advice

When filing a nonresident return it is important to prepare that return first to ensure proper calculations. You should allocate all earned income to the state where it was earned. Please view this TurboTax FAQ for more information about allocating income between states. Unfortunately, you cannot get the W-2 corrected because it has been properly reported based on the state withholding information. The only way to receive a refund is by filing the Kansas state return. You still allocate income to the state where it was earned.

The Kansas Department of Revenue will consider her a part-year resident if she was Kansas resident for less than 12 months during the tax year. For more information about filing a part-year resident return(s) please view this TurboTax FAQ as well.
