How do I file both NJ-1040 and NJ-1040NR?

Hello,

 

In 2022, I lived in NYC (NY) for 6 months, then moved to Jersey City (NJ) for 6 months. All year I worked for a NJ employer. TurboTax guided me to submit the following residency statuses:

1) For NJ : Part-Year Resident = simultaneously a Resident return (Forms NJ-1040) and a Nonresident return (NJ-1040NR

2) For NY : Part-Year Resident (Form IT-203)

 

I think I managed to fill out both NJ and NY states properly. I can submit the NY State tax properly through TurboTax. I am faced with 2 questions though about NJ State.

 

Question 1:

For NJ, it appears TurboTax is unable to submit my Nonresident return (NJ-1040NR) electronically (see following screenshot). It can however submit my Resident return (NJ-1040) electronically. What is the best way for me to proceed in this case?

A) Do I submit my Resident return (NJ-1040) through TurboTax electronically, then print my Nonresident return (NJ-1040NR) and mail it? In this case, will TurboTax supply all documents I need to mail-in NJ-1040NR? Do I have to write an explanation letter with my mailed-in return?

B) Or do I refrain from submitting either NJ returns electronically, and rather mail-in both NJ-1040 and NJ-1040NR? I am thinking this may be less confusing for the NJ tax authorities.

 

Question 2:

After I completed my NJ return, I have refunds both from the resident and nonresident returns. It appears TurboTax is asking me to reallocate a portion of NJ withheld taxes from nonresident to resident, such as the nonresident refund is zero'ed out. That would attribute more NJ withheld taxes to my NJ resident days than what was actually withheld while I lived in NYC. Why is TurboTax doing that? Is this appropriate/legal?

    Mail both your resident and non-resident return together so New Jersey has both in the same place. Use certified mail with delivery confirmation.

     

    Allocate your income and withholding according to your resident and nonresident periods.

     

    New Jersey says, “If you also complete a part-year resident return, allocate your income, withholdings, and payments between the part-year resident and part-year nonresident returns as appropriate.”

    Thanks for your response Ernie. That is the direction I was leaning towards - do not submit a return for NJ electronically via TurboTax. Instead mail-in both Resident (NJ-1040) and Nonresident (NJ-1040NR).

     

    Can I print already filled out NJ tax forms NJ-1040 and NJ-1040NR from TurboTax online, without filing NJ taxes through TurboTax?

     

    I have not filed any of my federal / NY / NJ taxes electronically yet. So far I don't see an option in TurboTax to print the filled out forms.

    There should be no issue mailing the Forms to NJ. I suggest you mail them by certified mail receipt for tracking purposes.
