Question

I live and work in California. My spouse has been a resident of West Virginia all of 2023. My income is our only income. How does this affect our state income taxes?

My spouse and I married in California 10 years ago, but she moved to WV permanently at the beginning of 2023. Do we need to pay state income taxes in both states if all of our income is earned in California? Do we need to pay state income taxes on all the income in each state or half in each state? Do we have to file separately or can we still file jointly?

If you did not work or live in WV at any time in 2023 and your spouse has no income from a WV source then you only report your income on the California state income tax return.
