I live in NC and own an LLC. Do I need to file a NC state return?

I was getting ready to purchase the NC version for Turbo Tax Business and read one of the help links that indicated I may not need to file an NC return for the 2 member LLC. I clicked the link and could not find where to click on North Carolina to determine if I needed to file.

You might have see that information related to the annual report filing. The annual report must be filed each year by April 15 except that new LLCs don’t need to file a report until the first year after they're created. The filing fee is $200.

Yes, you need to file a NC LLC return. An LLC designated as a partnership files federal Form 1065 partnership income tax return and files a North Carolina D-403

  • Per North Carolina Department of Revenue: Unless specifically exempt under G.S. 105-125, all active and inactive domestic corporations, and all foreign corporations with a Certificate of Authority to do business, or which are in fact doing business in this State, are subject to the annual franchise tax levied under G.S. 105-122.
