    Yes, you need to file a Virginia return for your spouse's income.

     

    You can file a joint return for your federal tax but then should file married-separate for Virginia. First, complete a married-separate federal return for your spouse that you will use to prepare a Virginia married-separate return. You will file the Virginia return but not the federal return.

     

    Next, prepare a federal return that includes both of your incomes that you will use to prepare and file your New York return and your federal married-joint return.

     

    You may find it advantageous to use the desktop version of TurboTax to prepare the returns, since you can prepare multiple returns for the same price. You can download your online return to your computer by using the Tax Tools menu option on your left menu bar, and then Tools and then Save your 2021 return to your computer
