I received a letter from the NY State Dept of Taxation and Finance. It said "we need more info about your NY State income tax return..

about the pension and annuity income exclusion claimed.  My question.  This is an annuity I received b/c my Mom passed.  I paid taxes for this income on the federal but not for NY state.  Are pension/annuity payments to beneficiaries excluded from NY state income tax?

NYS Publication 36 states (on page 13):

 

"If you received pension and annuity income as the beneficiary of a deceased officer or employee of the United States, New York State, or local government within New York State, you may also make this subtraction to the extent that the distributions are included in your federal adjusted gross income."
