Question

I teach online for Indiana but live in the state of Texas, do I need to file taxes for Indiana?

I don't physically go to Indiana, but I teach online for them. Since Texas does not have state taxes, I was told by the Indiana Department of Revenue last year after submitting a protest that I would have to pay for any income earned from the state of Indiana. I am confused because I was also told that I don't have to file state taxes for them since I am a non-resident and I can't have Indiana state taxes held from my paycheck. What do I do?

    No, you are not required to file an Indiana (IN) tax return because you were not physically present in IN while doing your work. File a return as a full year nonresident for a full refund if your employer is withholding IN state tax from your wages.

    According to the Indiana (IN) Department of Revenue, you are required to file a return as a nonresident.

    • If you were a full-year nonresident of Indiana, but received any income from Indiana sources, you must file your Indiana income taxes.

    Indiana income includes income from the following sources:

    1. Winnings from Indiana riverboats, pari-mutuel wagering, and lotteries;

    2. Labor or services performed in Indiana, including salaries, wages, tips, commissions, etc.;

    3. A farm, business, trade or profession doing business in Indiana;

    4. Any personal property located in Indiana;

    5. A partnership or an S corporation doing business in Indiana;

    6. Stocks, bonds, notes, bank deposits, patents, copyrights, secret processes and formulas, goodwill, trademarks, trade brands, franchises, and other property where earnings are a part of an Indiana business;

    7. Trusts and estates given to nonresident heirs; and

    8. Pensions and most interest and dividends are taxed by your state of residence when you receive them
