Question

I work remote from Tx for a company based in CO. They have CO income tax on my w2 and their first out of state employee. Thought it was based on where I live?

Do I have to pay the taxes or should I get it all back?

You should get it all back.  CO considered income earned in the state by nonresidents to be income that you earn while physically present in the state, not working remotely.. To get a refund, you will need to file a nonresident CO return and enter your W-2 but with $0 as state wages and however much you had withheld as your state withholdings. 

 

You should also have your employer make the changes so they do not withhold taxes for CO anymore.
