Hello All

I got a letter from the IRS stating that I need to file taxes for a state which is not mentioned in my W2 i.e. did not work there. Here is my situation:

I received a letter from the IRS for 2016 to pay taxes for IL state.
In 2016, I worked for CA state (also mentioned in my W2) and paid CA state taxes. Filed married separately for 2016.
MY wife (ex-wife) was studying in IL and we rented a property to stay there. As she was from India, the rental was all on my name and I used to visit her frequently.
My W2 for year 2016 has the same IL address of rental property.
The letter from the IRS states that I need to pay for IL for 2016, but I did not work there and have no income from that state.
Please help/suggest me what to do.

Please clarify the IL property issue.  Were you paying rent for an apartment.  Or did you purchase a property, and rent it?

I was paying rent.

It was not an apt but a home(town house) for rent

This sounds unusual.

  • The IRS usually doesn't send out letters regarding the states, so first confirm where it is from.
  • The IRS will put a contact number on the form.  You can call to confirm it's from them.
  • There is no tax obligation for paying rent.
  • If you didn't earn money in IL, there wouldn't be any tax obligation.

Be cautious.  Confirm everything before making any decisions.
