Live and work in MA but traveled to NYC during the year and NY is showing on my W2 how do I allocate income to NY?

I live in MA and my work location is in Boston however I traveled a few weeks this year to work from the NYC office and my W2 is showing income for NY at my full salary. When I file my nonresident NY return do I just allocate that income by the days I was actually in the NYC office?

You can allocate by days or income percentage. 

 

Income percentage is generally easier, but New York has been pre-auditing non-residents and requiring them to fill out an equivalent days worked worksheet before releasing the refund, so if you choose income percentage, you may end up doing a days calculation anyway. However, you may not get a pre-audit.

 

You can try it both ways and see which one works out better for you and then decide.

 

  1. On New York Income Allocation, say No to Were all of your wages and/or your self-employment income earned in New York State?
  2. Edit Your W-2 on Your Form W-2 Summary
  3. Choose Allocate by Number or Days or Allocate by Percentage
