Question

Lived in GA all of 2023, lived in NY 2022 - Bonus from NY

Please help, I am having trouble knowing how to fill out the non-resident state.

I lived in GA all of 2023, I moved from NY in 2022. My bonus on my W-2 is from 2022, so both states are showing on the W2.

I'm using made up numbers, but this is the gist from my W2

Georgia Income: 80k Georgia tax $8k

NY Income: 100k New York tax $1k

How do I enter this when filling out the non-resident NY form? It asks me how many days I am in NY, and I put 0, but I don't think that's correct.

Thank you!

That would be fine, file as a non-resident for New York.

Allocate the bonus as money attributed to New York in the TurboTax program.

New York will tax you on it.

Next, do your Georgia, You need to claim all your income.

Georgia will give you a tax credit for the tax you paid to New York for the bonus.

Thank you so much for your quick response, so if my bonus was $10k for example, just allocate as $10k to NY? I assume my bonus before taxes were taken out.

Yes, you should report the gross amount of your bonus to New York (NY).  Even though you received the money in 2023, based on the information, you actually earned this money from your NY employer before the move.  As indicated, prepare the NY return first, then your Georgia (GA) return to be sure you receive the appropriate credit. TurboTax will carry the information.  If you already did your GA return, go to the NY return to find the tax, then watch for the credit on your GA return to enter the wages and tax liability on your NY return.

The credit for taxes paid to another state on the same income is used on your resident state because they do not want you to pay taxes twice on the same income.  As the resident state all worldwide income must be included.

The credit for tax paid to another state on the same income will be the lesser of:

  1. the tax liability actually charged by the nonresident state, OR
  2. the tax liability that would have been charged by your resident state
