M1NR for Resident Spouse and Part Year resident Spouse.

Hello Everyone,


I have a question about the form M1NR for Minnesota state tax returns.

 

Background Facts:

I moved to the US in middle of 2023 as a Green card holder.

I was not a US resident prior to this.

I have not earned any income in 2023 other than in Minnesota.

I have been in Minnesota for less than 183 days in 2023. 
I filed MFJ with my spouse for federal. 
My spouse has been a resident of Minnesota for the entirety of 2023. 

 
My questions are as follows:
 
1. I believe I need to file M1NR as I have not been in Minnesota for the whole year. Am I right? 
 
2. If so, what Residency is my spouse in the Schedule M1NR?
My spouse lived and worked in Minnesota for the entirety of 2023 and would be a Full-year Resident. 
However, there is no section to enter that information in the Schedule M1NR, Non-resident/Part-Year Residents Form (see attached image).
 
As seen on M1NR, there is no spot for Full year resident. There are only spots for Full-year Non-resident or Part-Year Resident.

If you are filing a joint Minnesota tax return with your spouse, you do not file a Schedule M1NR.  Since all of your income in 2023 was earned in Minnesota, I don't see any reason for you to file separately.
