Married Couple Filing Separately (NY, Maryland), State Tax Filing, Standard Deduction

Hello, I work and live in NY state while my husband works and lives in Maryland state. 

We are married filing separately.

We are doing standard deduction for both federal and states tax filing.

However, does he have to file NY state tax return and do I have to file Maryland state tax return to make sure that we select the same deduction method for both states' tax filing?

    No.  You each file your separate federal returns and only your respective resident states with only your respective incomes and the federal standard deduction.  

     

    Note:  NY allows you to take itemized deductions on your NY state return even if you take the standard deduction on your federal return.  

     

    MD does not.  Your spouse must take the MD standard deduction if taking the federal standard deduction.
