My husband owes money to a school in MA and they have intercepted our state tax. I was unaware of this debt, and was told that I can’t my portion back because it was joint. Can they also take our joint federal tax return? We have been filing jointly for a couple years and they never have, but I’m worried they can decide to later on.

 

 

side note: he had this debt way before me, but because he and I have not worked in MA, they couldn’t take it by state tax refund. he mentioned they took it one time, so he stopped working in MA to avoid it. Unfortunately, this was without my knowledge.

Yes, Massachusetts has a form M-8379 which is for a non-debtor spouse to request relief similar to the Federal Allocation, if  there is a prior debt of MA State income tax which can be allocated to one spouse. TurboTax doesn’t handle this form, however. You would have to fill it out by hand and mail it.
