Question

Me and my husband are both California residents but he works for a company out of Colorado therefore every paycheck he paid Colorado taxes. We filed jointly, why if we filed as non-resident for Colora

If your husband was physically in CA when he was working for this company, the company should not have withheld any COO state tax for him.  You should now be able to enter that you had NO earnings for CO on the nonresident return and get all your CO tax back.  You should also have the company correct their withholding as soon as possible.  Do not say you had double taxed income on your CA return because you'll be getting all that tax back from CO.  All your income should just be taxed as a CA resident.
