We are retired, live in Florida more than six months  and are residents with Florida drivers licenses and vote in Florida. We have property in Missouri and live there a few months of the year. How do we file our Missouri tax? Are we part residents even though we dont earn income fro  this state or are we non residents?

    It depends. You are either full-year residents of Florida or Missouri. To be a part-year resident, you would have to permanently give up one of your homes.

     

    Having a driver's license does not mean you are a resident for tax purposes. Spending more time in one state is also no guarantee of being a resident of that state.

     

    If you lived in Missouri before you lived in Florida and still have a home there, you are probably a Missouri resident.

     

    Missouri has a residency chart to help you decide.

     

     

    Obtaining a Florida Homestead Exemption is a good way to establish Florida residency.

    We do have a Florida Homestead status.

    You probably are Florida residents. I couldn't tell you for sure. If you have Missouri tax withheld and claim $0 Missouri income, you may have an issue, so you should get your withholding changed.
