MSA and HSA Contribution Deduct should NOT be allowed for Non Pa state residents. Info was brought in via Fed form and we cannot delete from state. Seems Turbo fm issue.

The Pennsylvania Instructions say,

"Nonresidents and Part-Year Residents

 

Please read the instructions beginning on Page 43. Nonresidents and part-year residents use the same PA-40 form as PA residents."

 

On page 19 of these same instructions which are for resident and nonresident alike, we see,

"LINE 10. OTHER DEDUCTIONS

 

PA law allows four deductions against income. Deductions are allowed for: Medical Savings Account contributions; Health Savings Account contributions; IRC Section 529 Qualified Tuition Program contributions, and IRC Section 529A Pennsylvania ABLE Savings Account Program contributions."

 

And when we look at the nonresident instructions beginning on page 43, we see nothing in the instructions which says that nonresidents should treat MSA and HSA contributions any differently than residents.

 

Why do you believe that MSA and HSA contribution deductions should not be allowed to nonresidents? Can you point to the instructions or a notice or the tax code to support your conclusion?
