Question

My daughter moved to New York from California in October of 2023. I'm trying to find out how to file her taxes?

She is not a dependent.  Do we need to file tax returns in both states?

Yes, if she had income from both states.

Yes, if she has taxable income and/or withholding to report, she would file both California and New York returns as a part-year resident. 

 

To make sure that you report and pay the correct amount of federal and state taxes, prepare the Federal return first in TurboTax. Then, since she lived in California for the earlier part of the year, prepare that return next. TurboTax will ask questions about her dates of residency and the source (state) where each item of income was earned. Each state has its own rules for allocating income for part-year residents.

 

If you have to file a New York state return for the remainder of the year, you will be asked more questions in the program and will be able to exclude income from the other state and/or be eligible for a credit for tax paid to the other state, so that the income isn't double-taxed at the state level.
