My employer mistakenly paid taxes in a state I neither live or work in. I won't get the correct W2 before the deadline. What do I do?

My employer paid taxes in CA and I liv ein NY. I am waiting for a new W2. Do I have to file in both CA & NY and amend later?

It depends. If the California (CA) taxes are going to change or be removed, you can file now. Take care of the CA return later because you will get a full refund if the new W-2 still has CA withholding.

 

If the taxes for your resident state are going to change, you may want to file to eliminate any late filing fees and then amend as soon as you get a corrected W-2. The only concern is if you do owe tax on your resident return there could be late payment fees if it's not all paid by today.


You always have the option of filing the federal now and the states later.
