My wife earned income as a teacher assistant while a WI grad student. Is she a WI resident?

I lived in CO, but my wife is in grad school and was a TA for U Wisc. We file a joint return. Turbo tax is asking if she lived in another state besides CO, and when we state WI, it puts her as a resident of WI. Is that right?

No, you wife is not a Wisconsin resident. If your wife is in Wisconsin for school and did not intend Wisconsin to be her domicile, it is considered a temporary absence and she maintains her Colorado residency. Since Wisconsin does not have a statutory resident (based on the number of days she is in the state), she is a Wisconsin nonresident. You can change her filing in the Wisconsin section of TurboTax.

In the Personal Info section of TT enter CO as her state of residence and answer No to the question about living in another state. Answer Yes to the question about having "other state income." This will prompt the program to generate the correct tax forms.

Be sure to complete her non-resident WI tax return before her CO tax return, so that CO will credit her for the taxes paid to WI.

WI can tax the income she earned in WI; CO can tax all her income, including her income from WI. The credit granted by CO will in effect prevent double taxation.
