Question

NY - Do I need to file NY Non-resident Return as a FL resident with 1099-NEC income from a NY company?

I'm a full-time FL resident working as an independent consultant for a company located in NY.  My only self-employment income is 1099-NEC income from this NY company. Based on my understanding from reading NY Non-resident Return instructions, I do not need to file a NY return because (1) my "business" (self-employment) is not carried on in NY, or (2) I did not perform services in NY.

Can anyone confirm that this is correct?

If you did not physically work in NY, you do not need to file a NY return. It does not matter where the company is based from, it matter where you physically work.
