Resident State Tax

Hi All,

 

i am from India, but I will file taxes with section 7701(b),

 

Which will treat me as a resident of US. for Federal Taxes Returns.

 

(visa type is L1-B)

 

my question is .

as I have come to us on28th August and have been living in PA, 

am I eligible for claiming state tax as well. As I have not stayed 183 days in PA IN 2024.

 

please help.

The state definition of resident for income tax is different than the IRS.  You can file as a Part Year Resident of Pennsylvania for 2024 and will only have to include the compensation you earned in Pennsylvania.  (You do not have to choose the full year or dual status like the IRS.)

i was really confused because my tax consultant said . I cannot claim state tax credit.

 

does this mean . Even if i have not switched any state. But I have lived for less than 183 days in a state (IN USA as well) . I am eligible to claim tax credit as a part year resident for PA.

Yes. You may receive a tax refund for a portion (if not all) for any state income tax paid while you were a resident of PA.
