I own a home in Texas where my wife and kids live, but I worked and live in New Jersey for the most part of the year. I get 2-3 months off to see my family in Texas. Am I a resident of TX or NJ? I do not have an address in NJ my employer pays for our hotel/studio.

    You are a resident of Texas, but you still have to file a non-resident New Jersey tax return and pay NJ tax because you earned money in the Garden State.

     

    New Jersey defines your “domicile” as the place and state you consider your permanent home — the place where you intend to return after a period of absence (e.g., vacation, business assignment, educational leave).

     

    A corporate apartment is not a permanent home.
