You would need to amend your 2023 return. 

To amend your return using Turbo Tax Online.
 

1. Log into Turbo Tax
2. Select Scroll down Your tax returns & documents in your landing page.
3. Select Amend (change) 2023 return. 

To amend using the Desktop Software, go to:

1. Federal Taxes
2. Other Tax Situations>other tax forms
3. Amend a return

Once you return to your return through the amendment process, go directly to your Colorado State return tab.  This amendment will not affect your federal return because Tabor refund is only applicable for the State of Colorado.

Navigate towards the end of the state interview to the screen with the heading, "A Few Things Before We Wrap Your State Taxes", scroll down to "Other Situations", then click on Start or Revisit for "Sales Tax Refund".

There are two questions: one on number of days incarcerated and the other on your residency (from memory). You must pass through both of these screens to get the TABOR refund. If the program determines that you are ineligible for the credit, do not continue with the amendment process.

Once done, you should be able to efile your Colorado Amended refund. When you begin to file, indicate you wish to print and mail your federal return, since you won't be filing a federal amendment. When it asks if you want to efile your Colorado amendment though, do say yes.

You may have been asked these questions already when you originally prepared your Colorado tax return and may have already received the credit or declared ineligible after answering the qualifying questions.
