Tax return

So I’ve been living in Texas but never switched my licenses to Texas. This time they took out 2700 in state taxes. What can I do to provide to whoever I lived here in Texas. And not Oklahoma? I can provide lease agreement and whatever else needed.

    Did you work in OK?   If you worked in OK, even while living in TX, you are subject to paying OK state tax.

     

    And....did you move to TX during 2024?  Or did you live in TX for all of 2024?

    So I used to live in Oklahoma. But worked in Texas. But I’ve moved over here to Texas. But kept my Oklahoma DL AND had my w2 sent to Oklahoma.

    That does not answer the question of WHEN you moved from one state to the other.   Did you live in OK at any time during 2024?

    More----if you live in TX but work in OK---you need to file a non-resident OK tax return.

    I assume "they" is your employer.  Your employer appears to think you are still an OK resident and is properly withholding OK tax.  Just working in TX does not get you out of paying OK tax.

     

    You need to tell your employer that you are now a TX  resident. You can't just claim to be  a TX resident. You must actually BE a TX resident.  Get a TX drivers license and car registration,  have your mail sent to your TX address, register to vote in TX.  

     

    In the mean time, you have to file a 2024 non-resident OK return to claim a refund of the improper withholding. If you moved during 2024, you file a part year resident return (instead of non resident) to get some of the withholding refunded. Be sure to use you TX address. 

     

    Another issue is: what is the OK mailing address you are using. If you still own or maintain a home in OK, you may still be a statutory resident and subject to OK tax on all your income.   More details are needed.  

     

    For example, you can't lease a home in TX to stay in during the week, while you work, and return to your permanent home in OK on weekends, and call yourself a TX resident for tax purposes.  You would still be an OK resident.

    I have never worked in Oklahoma past 2 years. Been working in Texas since 2022 of May…. But as I said I just never switched my DL to Texas.

    • You can legally driver with a valid, unexpired driver license for another U.S. state, U.S. territory, Canadian province, or qualifying country for up to 90-days after moving to Texas.
    • Transferring Out-of-State Licenses: If you have a valid driver license from another U.S. state, U.S. territory, or Canada, you must surrender your out-of-state license and are not required to take the knowledge or skills exams.

    The way for you to recover tax that was withheld for  OK is to file a non-resident tax  return for OK
