TurboTax incorrectly won't allow e-File of State of IL return

I was filing Federal and State (IL) returns for my mother-in-law and father-in-law.  My mother-in-law passed away last April.  They are required to file a return in IL, but they neither owe the State, or get a refund.  TurboTax states that the Illinois tax forms cannot be e-filed, due to the need to fill out "Form IL-1310 Statement of Person Claiming Refund Due to Deceased Taxpayer".  Under the "Who must complete this form?" section of IL-1310, the second sentence states "However, if you are a surviving spouse filing a joint return with your deceased spouse, do not complete this form."

So if there is no need to fill out the form for the State of IL due to 1) no refund being claimed, and 2) Surviving spouse is filing the taxes and does not need to complete, then why can't we e-file the taxes?

 

Looks like a missed revenue opportunity for TurboTax!

    You should be able to file. I just went through the IL as a married couple, one deceased in 2024 and did not run into the 1310 issue. I also made my tax liability zero out. I got through the review and to the efile step. Obviously, I can't efile a fake return though.

     

    Delete the 1310 from the state:

    Online: see How do I view and delete forms in TTO?

     Desktop: If you are working in the cd/download TurboTax program:

    1. On the top right, there is a FORMS button. 
    2. Click on FORMS.
    3. Locate the form you want to delete.
    4. Click on the form name.
    5. Below the form, bottom left, select DELETE FORM button. 

    If you are unable to efile, contact support.
