An entity is not required to file a Utah return and issue a Utah K-1 if:
• it is not a pass-through entity taxpayer, and
• it maintains records that show each partner’s or member’s
share of income, losses, credits, and other distributive
items, and those records are made available to the Tax
Commission upon request.
If your entity issuing the K-1 is not required to file in Utah, they would not have issued a Utah K-1.
