Question

I am Active Duty Military. A Montana Resident. I live and stationed in Maryland. How do i fill this out correctly to reflect that. Do I have to file 2 state tax returns?

The question is HOR, should say Montana. This means non-resident for MD. If your only pay is military, no need to file a MD return. However, if you have a side job or a spouse working in MD, then you need to file.

 

 

MD says: Military Personnel

Residents. Residents entering military service remain Maryland residents for income tax purposes, regardless of duty station state, until a change of legal residence has been made.

Nonresidents. Nonresidents stationed in Maryland must file if they have earned income from Maryland sources other than military pay.

Military spouses. The spouse of a servicemember may elect the same legal residence state as the servicemember. For more in-formation,
