Question

I am active duty, my spouse claims my SOR - KY. She works in IN. It is saying she owes Ky state taxes, which should not be due to me being military. How to I avoid this?

Last year we simply filed 1040 form with reciprocal nonresident IN form IT-40RNR for state taxes. We did use an accountant and not TurboTax though. With filing through Turbotax this year it is stating she owes KY state taxes.

I saw nothing in the KY tax instructions which indicate that the civilian spouse of a KY-Military member is exempt from paying KY taxes on her income...income from anywhere.  Also, if you have other income besides your own Military pay, that might be taxed by KY too .

Might be worth it to go to the KY income tax page.''.and call them to ask about it.

Make sure you make it clear you are a KY HOR Military person, and civilian spouse also claims KY Residence.
