I’m active duty military and paid state tax to NY can I claim as non residual and get those state taxes back since I don’t live there while being active duty?

Yes, you need to file a NY nonresident state tax return.  But, if you earned income from NY sources other than your military pay, you may owe taxes on that non-military income.  If your only income while living in NY was your military pay you are not subject to NY state income tax, and will get a refund of taxes you paid.
