Currently in the process of selling my primary residence in GA. I am an active duty military member resident of FL. Am I exempt from GA tax withholdings requirements under O.C.G.A. 48-7-128? I am going to report the sale in my Federal taxes for the year as one should but not sure that I should be paying the state of GA.

Georgia only provides an exemption from taxation on wages directly related to your wages since you are part of the military.  However, any income from property located within Georgia or any independent business income would still be considered taxable within Georgia.  In this situation, you will need to file a nonresident Georgia return to report the sale of your home if there is any reportable gain.  Please see this link for directions on how to prepare your nonresident state return if you determine you have a reportable gain from the sale of your home within Georgia.
