Military Spouse Living in VA

I am trying to figure out which product to use to file my taxes. My husband and I live in Virginia. He claims WI as his home of record and I’m technically a resident of Virginia and paid taxes in Virginia. I know we can file jointly for federal, but not for each state. WI allows me to put myself and a nonresident, but Virginia says we have to file married filing separately. Is there a product that will allow me to do all of this?

    As the spouse of a military member, you have the option of also choosing to be a resident of the same state as your military spouse. In your case Wisconsin. Your income would be taxed only by the state of Wisconsin. Virginia would need to refund any state tax you had withheld. 

     

    If you wish to remain a resident of Virginia, you can use TurboTax, but the process is a bit complicated. Basically you file a Married Filing Jointly Federal return, then need to create two "Mock" federal returns filing separately to get the separate info into each separate state. Mail the state returns with the ORIGINAL joint federal return for each taxpayer. 

     

    You can do this with any TurboTax product, but we suggest using TurboTax Desktop. TurboTax Desktop gives more control to the taxpayer.
