MY 91 YEAR OLD MOTHER IN LAW HAS RECEIVED $263000 INHERITANCE FROM HER SON'S IRA

WHAT IS THE TAX CONSEQUENCE IF IT IS WITHDRAWN ALL IN 2023?  $263,000.00

    Any amount that is withdrawn will be taxable income in the year it is withdrawn.  The tax rate used will be the regular tax based on her income level which simply means there is no special tax treatment.  The rate will depend on her age, filing status and income (includes all taxable income).  The following link and tax rates will provide a general idea about the amount of tax for federal purposes only.  You would need to find out if it would be taxable to your state since all states have different tax laws.

     

    If for example  your mother-in-law is single and under 65, her standard deduction for 2023 would be $13,850.  Based on only that and the IRA distribution her taxable income would be $249,150.  As you can see the maximum rate for her would be 35% and a total tax of $59,097 (estimated).

    Marginal Rates: For tax year 2023, the top tax rate remains 37% for individual single taxpayers with incomes greater than $578,125 ($693,750 for married couples filing jointly).

    The other rates are:
     

    • 35% for incomes over $231,250 ($462,500 for married couples filing jointly);
    • 32% for incomes over $182,100 ($364,200 for married couples filing jointly);
    • 24% for incomes over $95,375 ($190,750 for married couples filing jointly);
    • 22% for incomes over $44,725 ($89,450 for married couples filing jointly);
    • 12% for incomes over $11,000 ($22,000 for married couples filing jointly).
       

    The lowest rate is 10% for incomes of single individuals with incomes of $11,000 or less ($22,000 for married couples filing jointly).
