How can I find out if my injured spouse claim was applied to my case. I mailed it in after my taxes were filed

If you filed the Form 8379 by itself after a joint return has been processed by the IRS, then processing will take about 8 weeks.

If you file Form 8379 with your original return, it may take 11 weeks to process an electronically-filed return or 14 weeks if you filed a paper return. More details are here https://www.irs.gov/taxtopics/tc203.html

If it's been longer than the number of weeks mentioned above, you can call the IRS to check the status of it. You can also call the IRS tax refund hotline at 800-829-4477, Monday - Friday, 7:00 a.m. to 11:30 p.m.

The number listed for IRS to check status of injured spouse claim is just a recording now because of Covid-19. Is there another way to find out if IRS has received our injured spouse claim and when our refund will be released?

Christina when you view your IRS transcript online look at your account transcript for 2019 you should have a code 971 showing they received it and the date it was received. It should be on there now or soon since your almost at your 8 week. Hopefully you see a code 846 that’s the date they will issue your refund.

I am in the same boat. It’s been 8 weeks and 5 days counted from the day I saw they received my injured spouse claim form 8379(971) and yet there’s no way to know when next my money will be received.

Yup, no way to check on the current status. I'm close to the nine week mark. The 800 number that I listed before is just the main number BUT problem is that now there's no live operators due to covid. Could you imagine if you owed the IRS money!?!? They'd turn you upside down asap to get that last penny. Yet they owe us thousands and are now late!

I mailed a form 8379 for my injured spouse. My husband is the one with debt not me... when can I expect my half of my taxes and my stimulus check?

His debt does not affect your stimulus check.

Go to irs get my payment, you will get the date your check will be mailed if you don’t have a direct payment on file. According to irs, it takes 8 weeks after a refund to get your 8379 form money back. We are in the same boat and it’s after 8 weeks now and nothing yet. Hope and pray to get it soon.

Advice? I filed my return electronically at the beginning of February to find out 2 weeks later my refund was being garnished due to my husband's student loans. I am the sole income in our household.  I mailed my injured spouse form 10 weeks ago and have not heard anything.  There is no way to speak to the IRS as when you call it says they have no live reps, I've called the Department of Education who say since it was garnished in Feb before the Cares Act I will not get the auto refund as others who waited until March to file(don't get me started on that...). To the best of my knowledge I should receive full refund as I am not the one responsible for the debt. I'm worried my form wasn't received or was put away somewhere to never be found.  I tried calling a taxpayer advocate today but have not heard back.  Has anyone else experienced this? Should I amend my return and submit again electronically with injured spouse? Is it just taking an extra long time for processing? If I knew they received it I would feel much better about it but I have no way to confirm they did receive it.   Any help is much appreciated.

Am going the same situation and I haven't heard anything from them I mailed my form on March 4th I actually took it in until the IRS office and I haven't heard anything I just got my whole taxes taken away and my stimulus check taken away

Unfortunately, yes, it it is just taking an extra long time to process anything at the IRS that was mailed in at this time, as the processing departments are closed.  

 

The average processing time for an injured spouse claim is 10-12 weeks.

 

Since it has been right at 10 weeks since you mailed your form, and the IRS stopped processing approximately 6 weeks ago, it seems highly likely that yours was not processed prior to the shutdown.

 

We do not know when the IRS is expected to resume operations but you can expect further delays once they do.  However, they will be processing items in the order that they were received when operations do resume.

Your situation will be similar, the IRS shutdown occurred shortly after your form would have been received and therefore your form will also be processed when operations resume.

Your welcome! I filed back on Feb 20- approaching the 11 week mark next Friday and nothing has been updated Dive they received it that day. I got on the phone and kept leaving daily messages at my local tax payer advocates office- he told me to fill out that form (911) and fax - now just waiting -

Do they contacted you if you made a mistake on filling out the form? I’m worried that I may have filled out something wrong and it just won’t get processed and I’ll never find out. I tried calling all the numbers but they said they aren’t allowing live agents due to reduced staff. So everything is automated.

Since the IRS is closed, the taxpayers advocate office can not help. That's what they told me when they called me back. I called a number I got for the IRS and it turned out to be the collections dept. The guy I spoke to said thats6the only dept open. All the rest are closed until mid July, from what he said. Even the examination dept, which is the dept that handles the IS forms.

I've put my injured spouse form in at the beginning of March after I found out my taxes were snatched. I don't owe anything but my wife has back child support she owes. I haven't heard anything from the irs and ever time I call I can't get in touch with anyone I even tried to check my status on amended returns. It keeps telling me that there's no record of a amended returrn.

Why would you check the amended return site? If you're just submitting an IS form it's not an amended return. Amending a return and attaching an IS form will delay the processing by 16 weeks.
