How can I find out if my injured spouse claim was applied to my case. I mailed it in after my taxes were filed

If you filed the Form 8379 by itself after a joint return has been processed by the IRS, then processing will take about 8 weeks.

If you file Form 8379 with your original return, it may take 11 weeks to process an electronically-filed return or 14 weeks if you filed a paper return. More details are here https://www.irs.gov/taxtopics/tc203.html

If it's been longer than the number of weeks mentioned above, you can call the IRS to check the status of it. You can also call the IRS tax refund hotline at 800-829-4477, Monday - Friday, 7:00 a.m. to 11:30 p.m.

If you mailed in after March 30- it will be stored until they are up and working- best bet is to contact your local Taxpayer Advocate leave a message file form 911 fax to the local fax to the local TPA office wait 3-5 days they should reach out to you

Hi my name is Linda Ross and I sent an injured spouse form into the IRS and they never got back to me I know the Covid 19 was going on but been trying to call and see how I can get my refund it was offset for my husband and I did fill out a form please help me if you can to get my refund thanks

@Jaylynn21 If you mailed the injured spouse form you are going to have a long wait--sorry.  Mailed returns, etc. have been piling up in trailers for several months. The IRS is just beginning to open the backlogged mail.

@2much Only the IRS would have that information, so you would need to reach out to them:  How do I contact the Internal Revenue Service (IRS)?

 

You can also try the Taxpayer Advocate Service, which offers help with tax issues you cannot solve on your own.

Did you ever receive your money back… was it all since he want working?

I did eventually get my refund.  His not working didn't matter.  It's because he has past student loan debts that I am not responsible for.  I file the injured spouse form with my 1040 every year now.  Last year I received my refund in full about 3 weeks after I filed.

@Sherri141 You want to know if your injured spouse form has been filed?   Well, how did you file it?   Did you e-file it with your tax return?   Or did you mail it later?   If you mailed it, it is going to take a very long time.   Mailed tax returns, etc. are taking 6-9 months to be processed by the IRS.
